| SUBJECT: | Teacher Participation at IEP Meetings |
Special education teachers / related service providers playa central role in the education of children with disabilities. They provide insight into the progress of the student in the classroom. They must also implement the IEP goals and objectives required to reach mastery and engage in activities that parallel the general education curriculum.
Federal Law and Part 200 Regulations of the Commissioner (§200.3{c)(2)(1))
require that the child's teacher is a mandated participant for all Individualized Education Program (IEP) meetings including reevaluations and triennial
evaluations and must participate in the conference in the school or at the Committee on Special Education. Related service providers should also be included on the team when a particular related service will be discussed. This participation may be in person or via teleconferencing. It is incumbent upon school administrators to ensure that teachers are informed of, and scheduled to attend, IEP meetings.
It a violation of Federal and State law if a teacher is not a participant at the IEP meeting. Furthermore. the IEP may be considered a nullity in a due process hearing.
