Article 14 - Vacation Periods and Scheduling

A. Amount
Full-time Faculty Members are eligible to receive paid time off which includes vacation, designated holidays, and designated non-instructional days during each contract year in accordance with their years of service (seniority) at the Art Institute of New York City as follows:
- Each contract year all full-time Faculty Members have two paid weeks off during the Winter break and two paid weeks off during the Summer break between academic quarters, as set forth in Appendix 3.
- Faculty Members with at least three years of seniority are entitled to schedule discretionary vacation time off equal to an additional work-week, as defined in Article 12.1 and 12.3, as provided below, or a twelfth week, in addition to their vacation time taken as provided in paragraph l.
- Faculty Members with at least ten years of seniority are entitled to an additional week off, to be taken during twelfth week(s), in addition to their vacation time taken as provided in paragraphs 1 and 2 above. Faculty Members with at least fifteen years of seniority are entitled to an additional twelfth week off (for a total of two per contract year). Faculty eligible for twelfth week(s) off pursuant to this paragraph are still required to post grades in a timely manner and otherwise prepare for the next quarter.
- The AiNYC academic calendar is set forth in Appendix 3. If the AiNYC academic calendar requires amendment for any reason during the term of the contract, AiNYC will notify the Union immediately and meet with the Union as soon as possible to discuss the change and the effects of the change. Any Faculty Member who relied on the calendar to schedule his/her vacation shall be held harmless from the effects of the change, whether financial or otherwise, and will be dealt with on a case-by-case basis.
B. Scheduling Discretionary Vacation
- Discretionary vacation days should be requested as far in advance as possible, and at least three weeks prior to the start of the term during which the vacation time is requested, if possible. The Academic Department Director must approve all discretionary vacation requests, but such approval will not be unreasonably denied. The Academic Department Director will approve discretionary vacation requests in writing within five days. Once approved, scheduled discretionary vacation time may not be changed except by mutual agreement of the Faculty Member and the Academic Department Director.
- If the Academic Department Director is unable to approve all applications for discretionary vacation days due to a lack of Instructors to cover scheduled classes during the time requested, seniority shall govern among those applying at the same time. However if the senior applicant previously received his/her choice of discretionary vacation time and another eligible applicant did not, the request of the senior eligible applicant who did not previously receive his/her choice of discretionary vacation time shall be approved.
