Article 22 - Assignments and Transfers

  1. All vacancies within the bargaining unit shall be posted internally for two (2) weeks. The posted notice shall indicate the time slot/shift, subject and status of the posted position. As used in this provision and elsewhere in this Agreement, the “time slots/shifts” for scheduling purposes are: weekday a) mornings or b) afternoons or c) evenings; or d) weekends.
  2. Before a new Faculty Member is hired for any bargaining unit position qualified current Faculty applicants will be transferred to open positions. Full-time applicants shall be given preference over part-time applicants. Seniority shall be determinative among applicants for a position who have the same Employee status.
  3. A full-time Instructor’s workload shall be filled through assignments in his/her regular workday time shift. In the event that a full workload cannot be scheduled in the current regular workday time shift due to a lack of course offerings, and after bumping part-time Instructors whose work the full-time Instructor is qualified to do, the least senior Instructor shall be transferred to his/her choice of assignment on another workday time shift for which he or she is qualified, and which is not assigned to another full-time Faculty Member.   Such an involuntary transfer shall be for one quarter, after which the Instructor shall be returned to his/her regular workday time shift unless he/she declines to return to the original shift. An Instructor who declines a return to the original shift in writing may remain on the shift to which he/she was involuntarily transferred in accordance with his/her seniority, or exercise his/her contractual right to apply for other positions. If the Instructor returns to the original shift, and the lack of course offerings persists, the next least senior full-time Instructor shall be rotated from the shift following the same procedure, and so on. Full-time Instructors who are involuntarily transferred for one quarter shall not be involuntarily transferred during the succeeding twelve months unless all other Instructors subject to rotation have been rotated during the preceding twelve months, in which case the Instructor next in order shall be rotated off the original shift.  An Instructor involuntarily transferred from a shift with a shift differential shall continue to receive the shift differential during the quarter he/she is assigned to the shift involuntarily.
  4. Faculty must be qualified to teach the courses and do the work assigned hereunder. Where the State of New York and/or accrediting bodies of AiNYC require specific credentials as a qualification to teach a particular course, only Faculty who possess the minimum credentials required by the State and/or accrediting bodies (as set forth in their official publications made available to Faculty by the Employer) shall be deemed qualified to teach the particular course.
  5. Classrooms and kitchens shall be posted for students in a locked case.
