ARTICLE THIRTY-SEVEN

DEFINITIONS

A.  Wherever the term "semester hours'' is used in this Agreement, it shall mean college credits.

B.   Wherever the term "Board'' is used in the Agreement, it shall mean the City Board, it being understood, nevertheless, that this contract is binding on all community school boards in accordance with Section 2590 of the Education Law.

C.  Wherever the term "seniority'' is used in the Agreement, it shall mean length of service as a paraprofessional employee in the bargaining unit in the district plus any seniority accrued as a day-to-day substitute paraprofessional.  Effective September 2006 “seniority” shall mean length of service as a paraprofessional employee in the bargaining unit, including seniority accrued as a day-to-day substitute paraprofessional.

ARTICLE THIRTY-EIGHT

NOT ICE LEGISLATIVE ACTION

The following Article is required by the Public Employees Fair Employment Act, as amended by Section 204a, approved March 10, 1969 :

It is agreed by and between the parties that any provision of this Agreement requiring legislative action to permit its implementation by amendment of law, or by providing the additional funds therefor, shall not become effective until the appropriate legislative body has given approval.
