Indiana’s right-to-work law was struck down by a judge who found the law violates a section of the state constitution that bars delivery of services “without just compensation.”
Judge John Sedia of Superior Court found the law wrongly requires unions to represent workers who do not pay dues. Indiana is one of 23 states that ban the collection of mandatory fees for representation from unions. Sedia declared the ban and associated criminal penalties unconstitutional. The state is appealing the decision to the Indiana Supreme Court.
