The U.S. Supreme Court has directed a lower court to reconsider its ruling allowing a transgender boy access to the boys’ bathroom at his high school, citing the Trump administration’s recent revocation of federal guidance on the matter. The case, Gavin Grimm v. Gloucester County School Board, has been a priority for transgender rights advocates who sought a Supreme Court decision affirming the rights of trans students.
“It’s not a loss. It’s really just a temporary setback,” said Mara Keisling, the executive director of the National Center for Transgender Equality.
Gavin Grimm, a student at Gloucester HS in Virginia, took his school to court in 2015 over its refusal to give him access to the boys’ bathroom. An appeals court ruled provisionally in Grimm’s favor following President Obama’s 2016 executive order directing public schools to provide equal access to school bathrooms for transgender students.
The Supreme Court had agreed to hear the case — the court’s first explicit transgender rights case — but reversed course after the Trump administration in February rescinded the Obama-era guidance.
