In June 2016, the Regents created a new local diploma option for students with disabilities who did not meet graduation standards through the existing appeal and safety net options. The original regulation, which automatically required superintendents to make a determination for every student who was eligible, has been changed. As of October 18, 2016, superintendents may only determine that an eligible student has met the requirements for this option upon receipt of a written request from an eligible student’s parent or guardian.
- This option is only available to students with disabilities who have a current individualized education program (IEP).
- A student with a disability who uses this option and graduates with a local diploma is no longer entitled to receive a free appropriate public education (i.e., special education and related services). The school must provide prior written notice to this effect to the student’s parent or guardian.
- At the IEP meeting where transition planning is discussed, the student’s parents must be informed about the student’s progress toward receiving a diploma. Additionally, graduation requirements must be explained, including eligibility criteria and the process for requesting the superintendent determination option.
