- Seniority is defined as the length of a Registered Nurse’s employment by the Employer as a Full-Time and/or Regular Part-Time Registered Nurse.
- A Registered Nurse’s seniority commences after the satisfactory completion of the probationary period and shall be retroactive to the Registered Nurse’s most recent date of hire. Seniority shall not accrue, for any purpose, during any unpaid leave of absence.
- Regular Part-Time Registered Nurses shall accrue seniority on a pro-rata basis.
- A Registered Nurse’s seniority shall be lost when the Registered Nurse (a) terminates employment voluntarily; (b) is discharged for cause; (c) is laid off and has not been recalled for a period of one (1) year (except probationary Registered Nurses, who have no recall rights under the Agreement); (d) fails to return to work within a reasonable period of time following notice of recall from layoff; or (e) extends a leave of absence granted by the Employer or is absent without leave for three (3) days, where in either case the Registered Nurse is deemed to have abandoned her/his employment and is removed from the payroll.
- The Employer shall maintain a seniority list at each location and provide a copy to the Union. The list shall be updated semiannually.
