Judge Philip Minardo rejected on Oct. 23 a motion to dismiss the Campbell Brown anti-tenure lawsuit. The motion had been filed by city and state teachers' unions, and lawyers for the city and state governments, who argued that legislative changes to the tenure process invalidated the lawsuit's claims about the harm of tenure.
In response, the UFT issued the following statement:
“Judge Philip Minardo’s procedural ruling is not the final decision in this case. The plaintiffs’ arguments will be decided by the New York State Appellate Division. The case remains on hold until the appeals court rules,” said Adam Ross, General Counsel for the United Federation of Teachers.
