Article 20 — Vacancies and Transfers

  1. Vacancies in bargaining unit positions shall be posted by the Employer on bulletin boards customarily used for posting notices to bargaining unit Registered Nurses for five (5) consecutive days prior to filling the position.  The posting shall set forth the bona fide job-related qualifications for the position.  All vacancies that remain after the five (5) day posting period will continue to be listed on the Employer’s website until filled.
  2. When a vacancy arises in a bargaining unit position, a Registered Nurse with a minimum of one (1) year of service in his/her present position may submit a request, in writing, to transfer to the vacant position.  Provided that the Registered Nurse possesses the qualifications to perform the duties of the position, the Employer shall grant the transfer as soon as practicable, with due regard for the Employer’s need to locate a replacement for the transferring Registered Nurse or any other business needs.  The Employer will use its reasonable best efforts to effectuate transfers within four (4) weeks after approval, but no transfer shall be delayed more than six (6) weeks.  If two (2) or more qualified Registered Nurses request to transfer to the same bargaining unit vacancy, the Employer shall select the qualified Registered Nurse with the greatest seniority unless there is an appreciable difference in their qualifications to perform the duties of the vacant position, in which case the Employer shall select the most qualified applicant.
  3. A Registered Nurse who transfers to a different job title within the bargaining unit shall be appointed to that position subject to satisfactory completion of a three (3) month probationary period.  If the Registered Nurse fails to satisfactorily complete the probationary period in the new position, he/she shall be returned to the position held immediately prior to the transfer.
  4. For purposes of this Article, the term “qualifications” may include those bona fide job-related qualifications set forth in the vacancy posting and the applicable job description, including but not limited to experience, clinical specialty and language proficiency.
