Article 3 — Non-Discrimination

Neither the Employer nor the Union shall discriminate against any Registered Nurse, with respect to any term or condition of employment, on the basis of race, color, creed, national origin, citizenship status, sex, age, religion, disability, marital status, sexual orientation, political belief, union activities or any other basis prohibited by federal, state or local law.  Nothing contained in this Article or any other provision of this Agreement shall limit a Registered Nurse’s remedies for unlawful discrimination to the grievance and arbitration procedure set forth in Article 26, unless the Union, with the concurrence of the Registered Nurse, opts to arbitrate a claim of discrimination, in which event the Registered Nurse shall be deemed to have elected the remedies under this Agreement to the exclusion of any other administrative or judicial relief that otherwise might be available to the Registered Nurse.
